Scope and Purpose of This Notice
This California Privacy Notice ("Notice") supplements PSD Underwear's Privacy Policy and applies solely to visitors, users, and others who reside in the State of California ("consumers" or "you"). It is adopted to comply with the California Consumer Privacy Act of 2018 ("CCPA") as amended by the California Privacy Rights Act of 2020 ("CPRA"), collectively referred to as "CCPA/CPRA," and any other applicable California privacy laws. Any terms defined in the CCPA/CPRA have the same meaning when used in this Notice.
This Notice describes the categories of personal information we collect, the purposes for which we use it, how we share it, your rights under California law, and how to exercise those rights.
Personal Information We Collect
We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked — directly or indirectly — with a particular consumer or household ("personal information"). In the past twelve (12) months, we have collected the following categories of personal information:

* Geolocation (Category G) is collected via mobile App only with your explicit prior consent. It is treated as Sensitive Personal Information — see the "Sensitive Personal Information" section below.
Personal information does not include:
- Publicly available information from government records.
- De-identified or aggregated consumer information.
- Information excluded from the CCPA/CPRA's scope, including health or medical information covered by HIPAA or CMIA, and information covered by the Fair Credit Reporting Act (FCRA), Gramm-Leach-Bliley Act (GLBA), or Driver's Privacy Protection Act.
Sources of Personal Information
We collect personal information from the following categories of sources:
- Directly from you. When you create an account, place an order, contact customer service, subscribe to communications, participate in a promotion, or otherwise interact with our Website or App.
- Indirectly from you. From observing your actions on our Website or App, including through cookies, pixels, and similar tracking technologies.
- From service providers. Including payment processors, fraud prevention providers, order fulfillment partners, and customer service platforms.
- From analytics and advertising providers. Including Google Analytics, Google Ads, Meta, and Rakuten Advertising, which collect data through cookies and tracking technologies.
- From social networks. If you connect to our services through Facebook, Instagram, or other social platforms, we may receive your name, username, and email address from those platforms.
Sensitive Personal Information
Under the CPRA, precise geolocation data is classified as "sensitive personal information." We collect this category of information through our mobile App only where you have given explicit prior consent (e.g., when you enable location services on your device).
We use precise geolocation information only for the following limited purposes:
- To provide services you have specifically requested (e.g., finding nearby stores).
- To protect our legal interests and ensure the physical safety of individuals.
- To comply with applicable legal obligations.
We do not sell or share sensitive personal information with third parties for cross-context behavioral advertising. You may disable geolocation sharing at any time through your mobile device settings.
How We Use Personal Information
We use personal information we collect for the following business and commercial purposes:
- To fulfill orders, process payments, manage your account, and provide customer service.
- To respond to your inquiries, comments, and requests.
- To personalize your experience and deliver content, product recommendations, and targeted offers relevant to your interests through our Website, App, third-party sites, and via email or SMS (with your consent where required by law).
- To analyze Website and App usage, measure advertising effectiveness, and improve our products and services.
- To detect, investigate, and prevent fraudulent, malicious, or illegal activity.
- To administer contests, promotions, and loyalty programs.
- To comply with applicable laws, regulations, and legal processes, including responding to law enforcement requests.
- In connection with a corporate transaction such as a merger, sale, or reorganization.
We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.
Sharing Personal Information for Business Purposes
We may disclose your personal information to third parties for business purposes under written contracts that describe the purpose and require the recipient to keep the information confidential and not use it except to perform the contract.
In the preceding 12 months, we have disclosed personal information for business purposes to the following categories of third parties:
- Our affiliates and related entities.
- Service providers, including payment processors, fraud prevention providers, data analytics providers, cloud storage providers, IT service providers, order fulfillment partners, customer service platforms, and marketing companies.
- Advertising networks (e.g., Google Ads, Meta, Rakuten Advertising).
- Law enforcement and government authorities, when required by law.
- Third parties to whom you or your agents authorize us to disclose your personal information.
Sale or Sharing of Personal Information
We do not sell personal information in the traditional sense of exchanging it for money. However, under the CCPA/CPRA, sharing personal information with third-party advertising and analytics partners for cross-context behavioral advertising ("targeted advertising") constitutes "selling" or "sharing." You have the right to opt out of this.
In the preceding 12 months, we have sold or shared the following categories of personal information for targeted advertising purposes:

We do not and will not knowingly sell or share the personal information of consumers under 16 years of age without affirmative authorization.
To opt out of the sale or sharing of your personal information, you may:
- Enable the Global Privacy Control (GPC) signal in a supported browser or extension (visit globalprivacycontrol.org).
- Click the "Do Not Sell or Share My Personal Information" link in the footer of our Website.
- Email us at privacy@psdunderwear.com with subject line "Opt Out of Sale/Sharing."
Once you opt out, we will wait at least 12 months before asking you to reauthorize. You may opt back in at any time by contacting us.
Your California Privacy Rights
The CCPA/CPRA provides California consumers with the following rights with respect to their personal information:

Submitting a Verifiable Consumer Request
To exercise your rights to know, correct, delete, or obtain portability of your personal information, submit a verifiable consumer request by:

Verification
We are required to verify your identity before fulfilling your request. We will ask you to provide at least two (2) data points that we can match against the personal information we maintain, such as your name and email address or a recent order number. We cannot respond to your request or provide personal information if we cannot verify your identity. Making a request does not require you to create an account with us.
Authorized Agents
You may designate an authorized agent to make a request on your behalf. To confirm the agent's authority, we require one or more of the following: (1) California Secretary of State authorization; (2) written permission signed by you; or (3) a power of attorney. We will also independently verify your identity and the agent's identity before processing the request.
Response Timing and Format
We will acknowledge receipt of your request within 10 business days and endeavor to substantively respond within 45 days. If we require more time (up to 90 days total), we will notify you in writing with the reason and the estimated completion date. We do not charge a fee to process or respond to a verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.
You may only submit a request to know or for data portability twice within any 12-month period. Any disclosures we provide will cover the 12-month period preceding our receipt of your request.
Notice of Financial Incentive — Loyalty Program
We may offer exclusive discounts, rewards, free shipping, or other perks to customers who participate in our loyalty and rewards program ("Program"). Under the CCPA/CPRA, this may be considered a financial incentive in exchange for the collection and retention of personal information.
In connection with the Program, we collect personal information including identifiers (name, email address), commercial information (purchase history, referral activity), and engagement data. This information is used to calculate and deliver Program benefits.
Participation is entirely voluntary. To join, follow the registration instructions on our Website or App. To opt out or withdraw from the Program at any time, contact us at support@psdunderwear.com. The value of the personal information collected through the Program is reasonably related to the cost of providing Program benefits.
Additional California Privacy Rights
Shine the Light (Civil Code § 1798.83)
California's Shine the Light law permits California residents to request, once per calendar year and free of charge, information about any personal information we shared with third parties for their own direct marketing purposes in the preceding calendar year. To make such a request, email us at privacy@psdunderwear.com with the subject line "Shine the Light Request."
CalOPPA — Do Not Track
Under the California Online Privacy Protection Act (CalOPPA), we disclose our Do Not Track (DNT) practices. We honor Global Privacy Control (GPC) signals, which function as opt-out signals for the sale and sharing of personal information. We also honor browser-level DNT signals where required by applicable law. Users may visit our Website anonymously, and our Privacy Policy is linked prominently from our homepage. For changes to our privacy practices, we will update this Notice and our Privacy Policy, and notify users by email or homepage notice where required.
Retention of Personal Information
We retain personal information for no longer than is necessary for the purposes for which it was collected, or as permitted or required by applicable law. The criteria we use to determine retention periods include: (1) the length of our ongoing relationship with you; (2) whether there is a legal obligation to which we are subject; and (3) whether retention is advisable in light of applicable statutes of limitations, litigation, or regulatory investigations.
Changes to This Notice
We reserve the right to amend this Notice at our discretion and at any time. When we make material changes, we will notify you by email or through a prominent notice on our Website homepage. The date this Notice was last revised is identified at the top of the page. Your continued use of our Website or App after any changes become effective constitutes your acknowledgment of the revised Notice.
